These Terms of Service (“Terms”) govern your use of aestheticsxart.com (the “Site”) and any purchase you make from AestheticsXart (“we”, “us” or “our”). By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least the age of majority in your country of residence, or have the consent of a parent or guardian, to place an order.

2. Products

Our products — art prints, canvases, framed prints and phone cases — are made to order. We reproduce every artwork as faithfully as possible, but colours may vary slightly from what you see on screen, and natural variations in paper, canvas, wood and printing may occur. Sizes are listed on each product page.

3. Prices and payment

All prices are shown in the currency selected on the Site and include free worldwide shipping. Import taxes or duties, where applicable, are the customer’s responsibility. We may change prices at any time, but the price charged is the one shown when you placed your order. Payment is processed securely at checkout by our payment providers.

4. Orders

Your order is an offer to buy. We may refuse or cancel an order — for example in case of a pricing error, suspected fraud or product unavailability — and will refund any amount paid. You can cancel within 2 hours of purchase; after that your order is in production.

5. Shipping, returns and refunds

Delivery, returns and refunds are governed by our Shipping Policy and Refund Policy, which form part of these Terms. Because products are made to order, we do not accept returns for change of mind; damaged, defective or incorrect items are replaced or refunded.

6. Intellectual property

The Site’s design, text, logo, graphics and product photography belong to AestheticsXart or its licensors. You may not copy, reproduce or use them without our written permission. Products are sold for personal use and may not be resold or reproduced commercially.

7. Accuracy of information

We try to keep all information on the Site accurate and up to date, but it may occasionally contain errors in descriptions, prices or availability. We may correct errors and update information at any time without prior notice.

8. Prohibited uses

You may not use the Site for any unlawful purpose, to infringe the rights of others, to upload malicious code, to scrape or collect data, or to interfere with the Site’s security or operation.

9. Third-party links and services

The Site may link to or use third-party services (such as payment and shipping providers). We are not responsible for their content or practices, and your use of them is subject to their own terms.

10. Disclaimer

The Site and products are provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties not expressly stated in these Terms. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

11. Limitation of liability

To the extent permitted by law, AestheticsXart is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold AestheticsXart harmless from claims arising from your breach of these Terms or your misuse of the Site.

13. Privacy

Your use of the Site is also governed by our Privacy Policy.

14. Governing law

These Terms are governed by the laws applicable in the country where AestheticsXart is established, without regard to conflict-of-law rules, and without depriving you of the protection of mandatory consumer laws of your country of residence.

15. Changes and severability

We may update these Terms at any time; the version posted on this page applies. If any provision is found invalid, the remaining provisions remain in full effect.
